Marialyn Barnard has served on the Texas Fourth Court of Appeals since January 1, 2009, when then Governor Perry appointed her to the bench. After serving two years as an appointed appellate justice, the people of Texas elected and re-elected Justice Barnard to continue serving on the appellate court. As an appellate justice, Justice Barnard has written well over 1,000 civil and criminal opinions from the south Texas 32 county district. As a proud Texan born into a military family, Marialyn Barnard has a strong work ethic, a drive for excellence in her work, and a deep commitment to the Constitution and rule of law. She is dedicated to serve the people of our great State of Texas and our great United States of America.

Before serving as judge, Marialyn was appointed to serve as Assistant United States Attorney (AUSA) for the Western District of Texas by then U.S. Attorney General Janet Reno. Marialyn has also served as a corporate counsel and as a private practice attorney. After graduating from St. Mary’s University School of Law, Marialyn served as a state court appellate briefing attorney and as a federal law clerk, drafting civil and criminal orders and opinions for United States District Judge Orlando L. Garcia, currently Chief Judge of the Western District of Texas. After 25 years of legal experience as an attorney and judge, Justice Barnard consistently receives high marks in judicial evaluation polls. She also receives accolades from professional and civic groups; her honors and awards are many.

Justice Barnard has always had a passion for children and families. She was a public school teacher for several years teaching high school English in Northeast Independent School District (I.S.D), Lackland I.S.D., and Commerce I.S.D. She served as a social worker with the Texas Department of Human Services in Food Stamp and Aid to Families with Dependent Children. Justice Barnard is a mother of two—married daughter and married son, and she is a grandmother of two very precious grandsons. She has been married to her high school sweetheart for over 40 years.

As an attorney, Marialyn prosecuted civil fraud cases, handled civil litigation, business litigation, employment cases, tort cases, and corporate investigations. She also handled several pro bono cases for indigent individuals who needed wills and sought divorces. She has served as President of the Rotary Club of San Antonio that promotes education and health locally and internationally, Board Member of Child Advocacy (CASA) of San Antonio, Board Member Big Brothers Big Sisters, Advisory Board Member Lighthouse for the Blind, Board Member Women’s Chamber of Commerce, and many more service organizations.

In law school, Marialyn was selected for prestigious internships with Texas Supreme Court Justice John Cornyn, Texas Court of Criminal Appeals Charlie Baird, United States Attorney Office for the Western District of Texas.
